Agreement to Terms and Conditions

The user acknowledges having carefully read the terms and conditions set forth below. These terms and conditions, along with Tegdar Center's Privacy Policy, relate to your subscription and use of the pages, website, and application of Tegdar Center, as well as all means of communication with the user, such as WhatsApp or other channels of communication with the user or client.

Your use of the Tegdar Center website constitutes your agreement to accept the terms and conditions of this agreement, which includes all the details mentioned herewith, and serves as confirmation of your commitment to comply with the content of this agreement with Tegdar Center. This agreement shall take effect immediately upon your use of the website or application. Tegdar Center reserves the right to change these terms and conditions at any time as required. The client must ensure to review the terms and conditions periodically without the need for Tegdar Center to resend them.

Registration and Subscription Process

  • Tegdar Center for Nutrition is a Nutrition Center licensed by the Ministry of Health in the Kingdom of Bahrain. Therefore, we require some basic information, including but not limited to the ID number of the client, to open your personal file at the center. This information falls under the mandatory requirements stipulated by the Ministry of Health, with the assurance that all provided information will be treated with strict confidentiality and the highest level of privacy.
  • It is the duty of the client, upon disclosing their information, to verify its authenticity and correctness and to ensure that it is updated and complete as required in the registration form.
  • It is the duty of the client to report any health issues, allergies, or other conditions they may suffer from that could negatively affect the nutrition plan and lead to other problems. In the event that such information is withheld, the client bears full responsibility for the results and consequences thereof.
  • The center reserves the right not to accept the client’s subscription or to postpone it if necessary, even if partial payment has been made. This applies if the client has not been notified of acceptance before completing payment, or if payment of the due amounts is not made within 24 hours from the time of notification of acceptance.
  • It is the client’s responsibility to follow up within one month from the payment date to receive the service paid for.
  • All payments made, whether for consultation or for any of our services, are non-refundable as they are due against time reservation. Implementation of the specifics of the service and benefiting from it remain the responsibility of the client; consequently, these amounts are non-refundable under any circumstances.
  • The subscription duration begins from the date the client receives the nutrition or exercise plan, and not from the date they start implementing it. The subscription is considered active for a full month and expires after this period (thirty 30 days) from the date of receipt of the plan.
  • Temporary Pause: The client may temporarily pause their subscription for only one week per subscribed month.
  • To ensure the continuation of their subscription, the client has the right to pay more than the value of the package/service selected for upcoming months to avoid subscription interruption.
  • The client may subscribe for more than one month for any of the available package types and obtain the renewal discount in any month following the first month of subscription, with the discount remaining valid for life. Accordingly, the package/service must be used within a maximum period of one month and one week from the date of subscription, if there was a postponement at the rate of one week per subscribed month (which is the maximum grace period per subscribed month). Please note that after the expiration of the grace period without starting the service, the subscription is considered cancelled and the amount paid is considered due and retained.

Personal Information

  • Tegdar Center makes sure that all possible protection and security measures are taken in order to protect and safeguard the identity and information of clients, such as name, address, and contact numbers, to prevent unauthorized access to those details.
  • The client and user acknowledge that any information exchanged via third party applications (including but not limited to WhatsApp and email) follows the privacy policy and terms and conditions of information exchange belonging to the platform of the communication method used, not Tegdar Center.
  • The client acknowledges and agrees to allow Tegdar Center to use certain information provided via this website or any other communication method with the Center, such as but not limited to weight, height, and similar information that does not in any way compromise the confidentiality of the person's identity stored by the Center. The Center acknowledges that this information will only be used in the context of public benefit for research and development purposes.
  • Continuing or renewing the subscription and/or payment of services serves as a direct acknowledgement by the client of accepting all terms, conditions, and privacy policy of Tegdar Center.
  • To maintain the client's privacy, each subscription and plan is tied to a specific phone number or membership and the subscription or shared data may not be transferred to another number under any circumstances.

Disclaimer

  • Tegdar Center shall not bear any responsibility for any harm or damage that may result from any virus attack or other technically harmful material that may infect any of your computer or mobile devices due to your use of our website, or as a result of downloading any material posted on it or on any website linked to it, which may lead to the disruption of the Center's website services or affect your device.
  • Tegdar Center bears no responsibility for the client's non-compliance with the suggested nutrition plan or the advice provided to him/her as part of his/her subscription. The client must take into account that each person's response to the nutrition plan varies according to body composition and the nature of its response to any change; therefore, Tegdar Center bears no responsibility if the client does not achieve their expected results.
  • The Center or any of its employees shall not bear any responsibility in the event that the client uses or sends the nutrition plan to another person who is not subscribed to Tegdar Center, which may lead to unexpected complications such as significant weight loss or gain, etc. This is because all nutrition plans are customized based on the client's specific condition and needs; therefore, it has to be clarified that the plan cannot under any circumstances be applied to anyone other than the subscribed client.
  • The client bears responsibility for their health or medical condition, if any, after consulting their specialized physician, keeping in mind that the nutrition program is designed with a team specialized in nutritional science to fit your physical condition and dietary needs. It is outside our scope to prescribe any medical or therapeutic drugs, as the responsibility of Tegdar Center is represented in sports and health education, nutrition, and general health awareness only.
  • It is the client's responsibility to retain all information and documents received from the Center, including but not limited to the nutrition plan, exercise schedule and their details, and any file or communication made with the Center. The Center bears no responsibility for their loss or damage, and the client has no right to request them to be resent after the end of the service period.

Follow-up and Appointments

  • The client bears the responsibility of sending their measurements at the agreed time between them and the Center, as well as the responsibility of communicating continuously with the Center.
  • The client has the right to inquire about any matter concerning the available packages and follow up on their subscription on a weekly basis for all online packages. They must read the details and features of each package individually before selecting the package and completing the payment process, bearing in mind that response times will be within working hours from 8:00 AM to 4:00 PM, Sunday through Thursday and taking into account relative work conditions and official holidays in the Kingdom of Bahrain.
  • The client bears the responsibility of responding to messages sent by the Center, whether inquiries or motivational messages, to ensure properly receiving the expected service.
  • The follow-up process is essential at Tegdar Center to ensure reaching the expected goal. In the event that the client fails to follow up and does not adhere to instructions and requirements on time, the benefit will be minimal, and the client alone bears responsibility for that.
  • The consultation duration is a maximum of 45 minutes; additional fees will be charged if the permitted service time is exceeded.
  •  In case of rescheduling or canceling an appointment, we must be notified 24 hours prior to the appointment time; otherwise, the session will be counted while follow-up via WhatsApp continues.
  • Rescheduling an appointment is allowed once only as a courtesy to the client and upon management approval. It cannot be rescheduled a second time, and the appointment will be counted in case of non-attendance.
  • The maximum waiting time for an appointment is 10 minutes; if late beyond the allowed time, the session will be counted.
  • Follow-up and response services for questions and inquiries pause during official holidays in the Kingdom of Bahrain and resume on the immediate next official working day. This period is considered part of the subscription period while ensuring that the client receives all mentioned and agreed-upon follow-ups in the package description, as the subscription period is calculated by the number of follow-ups, not the number of days.

Cancellation of Subscription or Membership

Mutual respect is a fundamental condition for subscribing with Tegdar Center. Consequently, the Center reserves the right to cancel the subscription of any person immediately upon any verbal or physical abuse toward any employee affiliated with the Center. The Center also reserves its legal rights regarding this person, and the amount paid in this case shall be considered due to the Center.

If the client delays contacting the Center to receive paid services for two months from the date of payment, the subscription will be considered canceled and the paid amount fully due.

The Center reserves the right not to accept anyone's subscription if the subscription might harm their health or if the selected package does not suit their condition, with a refund of the paid amount while the client bears all transfer fees and taxes, provided that they have not received their nutrition plan or any part of the service.

The subscription will be canceled immediately without refunding any paid amounts in the event that the client commits acts that violate public morals, such as bad language, defamation, swearing, or abuse, including but not limited to these actions.

Force Majeure

Upon the occurrence of any circumstances beyond the control of Tegdar Center, such as natural phenomena, disasters, epidemics, cybersecurity attacks, global or domestic labor strikes, power outages, or disruptions in communication channels between the Center and the client—including but not limited to WhatsApp or the Center's official website—resulting in the inability to provide the service, the Center reserves the right to postpone registration, terminate it, reschedule appointments, or make the appropriate decision according to the circumstance to the satisfaction of both parties.

Communication Mechanism

  • Subscription requests shall be made through any approved communication channel at Tegdar Center, including but not limited to the Tegdar Center application, WhatsApp, or email.
  • The Center's website serves as a medium to display some of its services as well as an electronic payment portal. The subscribed service is delivered through one of the Center's approved communication platforms.

Exchange and Refund Policy

After the payment process, paid amounts cannot be refunded in cash. Accordingly, the amount paid for the service will remain in your membership wallet at Tegdar Center for a maximum period of two months, after which the service will be considered received, and no cash refund or claims for unreceived services outside their specified time can be made under any circumstances, except in the following cases:

  1. If the Center refuses to provide the service to the client due to the unsuitability of the service to their needs or health condition, they will be transferred to an appropriate package or plan. If no suitable alternative is available, the paid amount will be refunded as an exceptional case.
  2. When the client mistakenly pays an amount greater than the required fee. The remaining balance will be kept in the wallet to be used within a maximum period of two months.
  • The client may exchange their package for another package of the same price, or for a higher-priced package provided that the remaining balance for the other package is paid.
  • The client has no right to refund amounts paid for subscription if they exceed the specified period for receiving the service due to lack of communication with the team. Furthermore, failing to take the service within the specified period cancels the service without any refund of the paid amount.

Note: After receiving the nutrition plan, no refunds will be issued under any circumstances.

Intellectual Property Rights

Innovative and intellectual rights for any invention, development, ideas, or discovery made by the Center are considered its exclusive rights. Tegdar Center retains all intellectual property rights to its materials and trademarks, including all related documents, files, ideas, marketing materials, and multimedia.

Amendments to User Agreement

  • The client acknowledges reading and agreeing to the terms, conditions, and privacy policy related to the Center prior to their subscription. Tegdar Center may make modifications to these terms and conditions at any time in accordance with the Center's requirements, and these modifications are made as the Center deems appropriate.
  • The client agrees with full authority that Tegdar Center may make major or minor amendments to this agreement without requiring additional consent from the client, at any time the Center deems appropriate. Therefore, the client is requested to review this page from time to time to stay informed of any amendments that may be made, as they form an integral part of these terms.

Discount Terms

  1. The client is entitled to a (Renewal Discount) of 10% upon renewing packages, including all former clients of the Center.
  2. The client is entitled to a (Referral Discount) of 50% when registering any new client through them under the following conditions:
  • The discount includes previous and current clients.
  • The discount is for the benefit of the primary client only (the referrer).
  • The discount value is 50% maximum, and discounts cannot be combined.
  • The client may benefit once from the discount for each new client, as the referral discount is available for an unlimited number of times provided a new client is referred each time the client wishes to benefit from this discount. The discount can be used according to the number of referrals without limit, provided that one discount voucher is activated per month and other vouchers are reserved for subsequent months.
  • The discount value applies once per month only.
  • The discount value applies after confirming the new client's subscription.
  • The discount value applies to the price of the same package subscribed to by the new client (i.e., the referred person) or to a package of lower value.
  • If the client refers more than one client, they may choose between using the 50% discount across a number of months equal to the number of clients on packages of the same or lower price, or combining the package prices of the referred clients to receive a 50% discount on a single package equal to or less than the total combined price for one month.
  • Transferring the discount to any person other than the eligible client (the referrer) is not allowed.
  • The discount value cannot be converted into cash nor claimed.
  • The discount validity is for a maximum period of two months, after which the discount expires and becomes invalid for use.
  • The Center reserves the right to disqualify the client from the discount in case of any manipulation or proof of non-eligibility without any prior notice.
  • The Center reserves the right to cancel or amend this offer at any time without prior notice.
